Participant Information Waiver and Form.

Assumption of Risk:

I, the undersigned, acknowledge and understand that participation in activities at ThisAbility Nonprofit Organization may involve risks of injury. I voluntarily assume all such risks associated with participation in these activities.

Indemnification Clause:

I agree to indemnify and hold harmless ThisAbility Nonprofit Organization, its officers, board members, employees, volunteers, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of my or the participant's involvement in activities at ThisAbility Nonprofit Organization.

Photo/Video and Safety Clause:

We take photos and video on the premises for everyone's safety. Photos may also be used for promotional purposes on our website, media, or social platforms.

Center Policies:

ThisAbility Nonprofit Organization serves children and adults with disabilities, and it is possible that individuals of varying age groups may be present in the center simultaneously. To ensure the safety and well-being of all participants:

All individuals must be accompanied by a caregiver at all times.

Caregivers are responsible for ensuring participants adhere to center guidelines and remain engaged in activities safely and respectfully.

Behavioral Support:

I understand that ThisAbility Nonprofit Organization is committed to providing a safe and supportive environment for all participants. Caregivers must inform the organization of any specific behavioral strategies or supports that can help ensure a positive experience for the participant.

Volunteer Basis:

I understand that all services provided by ThisAbility Nonprofit Organization are done so on a volunteer basis. Neither ThisAbility Nonprofit Organization nor any of its officers, board members, employees, or volunteers are receiving any form of compensation for their time or services.

Governing Law:

This agreement shall be governed by and construed in accordance with the laws of the State of Virginia. Any legal action or proceeding arising under this agreement shall be brought exclusively in the courts located in Virginia.

Severability Clause:

If any provision of this waiver form is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Medical Authorization and Transportation Permission:

In the event of a medical emergency, I authorize ThisAbility Nonprofit Organization to seek medical treatment for the participant. I understand that I am responsible for any medical expenses incurred. I also grant permission for the participant to be transported to a hospital or medical facility if necessary. I agree to indemnify and hold harmless ThisAbility Nonprofit Organization, its officers, board members, employees, volunteers, and agents.

Exclusion of Gross Negligence or Intentional Harm:

This waiver does not release ThisAbility Nonprofit Organization from liability for gross negligence, willful misconduct, or intentional harm.

Accessibility Compliance:

ThisAbility Nonprofit Organization is committed to providing an accessible and inclusive environment in accordance with the Americans with Disabilities Act (ADA) and all applicable laws. If participants require accommodations, they are encouraged to contact us in advance so we can ensure the best experience possible.

Age of Consent:

If the participant is under 18 years of age, this waiver must be signed by a parent or legal guardian. By signing this waiver, the guardian confirms they have the authority to do so and agree to all terms on behalf of the participant.

Insurance Disclaimer:

ThisAbility Nonprofit Organization does not provide personal accident, health, or medical insurance for participants. All participants or their legal guardians are strongly encouraged to carry personal insurance to cover any potential injuries, accidents, or losses incurred while participating in activities.

Mandatory Arbitration Clause:

Any dispute, claim, or controversy arising out of or relating to this waiver or participation in activities at ThisAbility Nonprofit Organization shall first be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Time Limit on Claims:

Any claim or legal action arising out of or relating to participation in activities at ThisAbility Nonprofit Organization must be brought within one (1) year of the date of the incident giving rise to such claim or action. Claims made after this period will not be accepted.

Informed Consent:

I acknowledge that I have been given the opportunity to ask questions regarding this waiver and its terms. By signing below, I confirm that I fully understand and voluntarily agree to all terms outlined in this waiver.

Waiver and Release

I, the undersigned, as the participant or legal guardian of the participant, understand that participation in activities at ThisAbility Nonprofit Organization involves certain inherent risks of injury. I acknowledge that the participant is voluntarily participating in these activities and agree to assume any and all such risks.

I hereby waive, release, and discharge any and all claims for damages for personal injury or property damage which I may have, or which may hereafter accrue to me or the participant, as a result of participation in activities at ThisAbility Nonprofit Organization. This release is intended to discharge in advance ThisAbility Nonprofit Organization, its officers, board members, employees, volunteers, and agents from any and all liability arising out of or connected in any way with participation in said activities, even though that liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above.

Acknowledgment of Responsibility:

By signing this waiver, I confirm that I have read and understand the terms outlined above, and I voluntarily accept full responsibility for the participant’s engagement in activities provided by ThisAbility Nonprofit Organization.

Off-Site Events and Activities This waiver applies to all events, activities, and programs organized or sponsored by ThisAbility Nonprofit Organization, regardless of location. This includes but is not limited to activities held at parks, schools, community centers, private venues, or any other off-site locations. Participants and their guardians acknowledge and accept any risks inherent to these venues, including but not limited to transportation risks, venue-specific hazards, and unforeseen circumstances. By participating, individuals agree to release and hold harmless ThisAbility Nonprofit Organization, its officers, board members, employees, volunteers, and agents from any liability related to these off-site events.

Scope of Agreement:

This waiver and release of liability applies to all current and future events and activities organized by Thisability Nonprofit Organization, regardless of location.
