Assumption of Risk:
I, the undersigned, acknowledge and understand that participation in activities at Thisability Nonprofit Organization may involve risks of injury. I voluntarily assume all such risks associated with participation in these activities.
Indemnification Clause:
I agree to indemnify and hold harmless Thisability Nonprofit Organization, its officers, board members, employees, volunteers, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of my or the participant's involvement in activities at Thisability Nonprofit Organization.
Photo/Video Release:
I grant permission to Thisability Nonprofit Organization to take and use photographs and/or video recordings of the participant for promotional and educational purposes, including on the organization's website and social media. I understand that the participant will not be identified by name without my explicit consent.
Behavioral Support:
I understand that Thisability Nonprofit Organization is committed to providing a safe and supportive environment for all participants. While we recognize that individuals with intellectual or cognitive disabilities may have unique needs, we ask that caregivers inform us of any specific strategies or supports that can help ensure a positive experience for the participant.
Volunteer Basis:
I understand that all services provided by Thisability Nonprofit Organization are done so on a volunteer basis. Neither Thisability Nonprofit Organization nor any of its officers, board members, employees, or volunteers are receiving any form of compensation for their time or services.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of the State of Virginia. Any legal action or proceeding arising under this agreement shall be brought exclusively in the courts located in Virginia.
Severability Clause:
If any provision of this waiver form is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Waiver and Release:
I, the undersigned, as the participant or legal guardian of the participant, understand that participation in activities at Thisability Nonprofit Organization involves certain inherent minor risks of injury. I acknowledge that the participant is voluntarily participating in these activities and agree to assume any and all such risks.
I hereby waive, release, and discharge any and all claims for damages for personal injury or property damage which I may have, or which may hereafter accrue to me or the participant, as a result of participation in activities at Thisability Nonprofit Organization. This release is intended to discharge in advance Thisability Nonprofit Organization, its officers, board members, employees, volunteers, and agents from any and all liability arising out of or connected in any way with participation in said activities, even though that liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above.
Medical Authorization and Transportation Permission:
In the event of a medical emergency, I authorize Thisability Nonprofit Organization to seek medical treatment for the participant. I understand that I am responsible for any medical expenses incurred. I also grant permission for the participant to be transported to a hospital or medical facility if necessary. I agree to indemnify and hold harmless Thisability Nonprofit Organization, its officers, board members, employees, volunteers, and agents
Acknowledgment of Understanding:
I have read this Waiver and Release of Liability and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
